By accessing or using the Diamond IQ Baseball mobile application and website (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Diamond IQ Baseball ("Company," "we," "us," or "our").

2. Eligibility

You must meet the following requirements to use our Services:

• If you are under 13 years old, you must have your parent or guardian's consent and supervision to use the Services
• If you are between 13 and 18 years old, you may use the Services with your parent or guardian's knowledge
• If you are 18 or older, you may use the Services independently

Parents and guardians who permit minors to use the Services are responsible for supervising their use and ensuring compliance with these Terms.

3. Account Registration

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

5. User Content

You retain ownership of content you create and upload to the Services ("User Content"), including training logs, videos, and profile information.

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving our Services. This license ends when you delete your content or account.

You are responsible for ensuring you have the rights to any content you upload and that it does not violate any third-party rights.

6. Intellectual Property

The Services, including all content, features, and functionality, are owned by Diamond IQ Baseball and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

7. Coach Responsibilities

If you use the Services as a coach, you acknowledge and agree that:

• You will only add players to your team with appropriate authorization
• You will use player data solely for coaching and team management purposes
• You will not share player information outside the team context
• You are responsible for ensuring you have any required permissions to coach minors
• You will maintain appropriate professional conduct with all players

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR TRAINING RECOMMENDATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAMOND IQ BASEBALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Diamond IQ Baseball, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
